The sudden demise of Senator Dr Ifeanyi Ubah has left a vacuum in the Anambra South Senatorial District, prompting the need for a by-election to replace him. However, there seems to be a delay in conducting this election, leaving the constituents without representation in the Red Chamber. This article examines the constitutional requirements for the conduct of by-elections in Nigeria, queries the delay in Anambra South, and highlights the implications of this delay.
Constitutional Framework
The 1999 Constitution of the Federal Republic of Nigeria (as amended) provides the framework for the conduct of elections in Nigeria. Section 78 of the Constitution empowers the Independent National Electoral Commission (INEC) to conduct elections, including by-elections. The Electoral Act 2022 also provides guidelines for the conduct of elections, including the requirements for candidates and the procedures for voting.
Requirements for By-Election
