Justice Musa Kakaki of a Federal High Court, Lagos, has struck out a fraud charges filed by Police Special Fraud Unit (PSFU) against a businessman, Afolabi Islamiu Olayinka and his companies Bowofab Global Services Limited.
Justice Kakaki struck out the charges, based on the settlement agreement reached by the businessman and the complainants in the charge.
It would be recalled that PSFU through its prosecutor, Barrister Chukwu Agwu, had dragged the businessman and his company before the court sometimes in 2022, on charges of conspiracy intent to defraud, and obtaining the sum of N58.527, million under false presence.
He had denied the allegations and pleaded not guilty to the four counts charge, upon being arraigned.
The businessman have consistently maintained his innocence on the charges while the trial lasted.
However, at the resumed hearing of the matter today, the prosecutor informed court of that the parties had settled, hence he urged court to strike out charge.
The businessman’s lawyer, Barrister J. A. Sanusi, equally made the same submission and urged the court to strike out the charge
Based on the parties submissions, Justice Kakaki therefore struck out the charges as well discharged the businessman and his company of all the offences.
