A 51-year old man, Michael Ayinde and his son, Abiola, 19, have been arrested and remanded in custody at the correctional centre for allegedly defiling a 17-year old daughter and younger sister in Oyo State.
P.M.EXPRESS reports that it was the decision of the Family Court in Ibadan, on Tuesday, 9th January, 2024, which ordered their remand over the alleged dastardly act.
The Presiding Magistrate, Mrs. O. O. Ogunkanmi, who did not take defendants’ plea, rather ordered their remand at the Abolongo correctional facility in Oyo town.
The defendants, who are the father and elder brother of the victim allegedly committed the offence at their residence in the Agboti Olosan area, Alakia, Ibadan.
The Magistrate, Mrs. Ogunkanmi, directed the prosecutor to duplicate the file and send for legal advice from the Oyo State Directorate of Public Prosecutions (DPP).
The Court also adjourned the matter till 21st February, 2024, for mention for the report of the DPP’s advice to be available, which will determine if the matter will be transferred to the High Court or not over jurisdiction.
The Prosecutor, Inspector Gbemisola Adedeji, informed the Court that between 2021 and December 2023, Abiola Ayinde engaged in unlawful sexual intercourse with his younger sister, leading to her pregnancy without consent and during
the same period, their father, Michael, allegedly had carnal knowledge of the victim which complicated the situation as to who among the defendants actually Impregnated the victim.
The prosecutor, Adedeji said the charges filed against the defendants contravened Section 34 of the Oyo State Child Rights Law, 2006, which attracts several years of imprisonment under the Criminal Laws of the State.
