A 23-year old man, Kehinde Ashimiu, has been arrested and charged in Lagos State for allegedly defiling his neighbour’s 16-year old girl after fondling her breasts, which got her confused.
P.M.EXPRESS reports that the incident happened on 10th July, 2023, at Baale Street, Abule-Ado area of Sabo, FESTAC, where they reside.
The Police alleged that suspect allegedly lured the girl to his apartment, used words of mouth to confuse her before he fondled her breasts, which made her become more confused and unable to resist him. He then penetrated her private part and having satisfied himself, he allowed her to go. The girl later realized herself and reported what happened to her parents.
The matter was reported to the Police in the area. The suspect, Kehinde, was then arrested and transferred to the Gender Section of the State Police Command for further investigation over his conduct.
During interrogation, the suspect claimed that he did not force her into the act and he actually did it with her consent, contrary to the girl’s claim that he actually lured her into the act without her consent.
The Police found him culpable for defilement becuse she is still a minor under the Law and subsequently charged him before the Ogba Magistrate Court for the alleged offence.
The Court did not take his plea when he was arraigned following a motion moved by the prosecutor, DSP Kehinde Ajayi, asking the Court to refer the matter to the DPP for legal advice.
Thus, the Presiding Magistrate, Mrs. E. Kubenije, ordered his remand in custody at the Correctional Centre at Kirikiri town, Lagos, pending when the DPP’s report will be ready and directed the prosecutor to duplicate the file and send it to the DPP.
The matter was adjourned till 29th August, 2023, for mention for the report of the DPP’s advice to be available, which will determine if the matter will be transferred to the High Court or not over jurisdiction.
