Man, 23, Docked For Luring Girl, 17 Into Sex By Fondling Her Breasts

A 23-year old man, Patrick David Ogbonnaya, has landed in trouble in Lagos State for allegedly luring his neighbour’s 17-year old girl into sex by fondling her beasts and defiling her in the process. 

 

P.M.EXPRESS reports that the suspect,  Ogbonnaya, has been arrested and charged for sexual assault and defilement under the Criminal Law of the State.

 

The incident happened at No. 18 Thyoba Sheik Street, Moshalashi Igando, Lagos.

 

According to the Police, the suspect lured the victim to his apartment, held her with words of mouth and fondled her breasts, which got her confused and she was unable to resist him before he penetrated her.

 

The victim later regained her senses, reported what happened to her parents and the matter was reported to the Police at Igando Division. The suspect was arrested and detained at the station for interrogation over his alleged conduct.

 

After interrogation, the Police found him culpable and charged him before the Ogba Magistrate Court for the alleged offence which attracts several years of imprisonment.

 

The charges read:

“That you, PATRICK DAVID OGBONNAYA ‘M’  at about unknown time at No. 18 Thyoba Sheik Street, Moshalashi Igando, Lagos State, in the Lagos Magisterial District, did defile one girl, 17 years old and thereby committed an offence contrary to Section 170 and punishable under Section 137 of the Criminal Law of Lagos Nigeria 2015.”

 

COUNT II:”That you, PATRICK DAVID OGBONNAYA ‘M’ on the same, time and place at the aforementioned Magisterial District, did unlawfully indecently assault the victim and thereby committed an offence punishable under Section 135 (1) of the Criminal Law of State of Nigeria 2015.”

 

COUNT III:”That you, PATRICK DAVID OGBONNAYA ‘M’ on the same time and place in the aforementioned Magisterial District, did infringe on the dignity of the victim by subjecting her to emotional injury and sex abuse and thereby committed an offence contrary to Section C27(10) (1) (a) according to Child’s Right Laws of Lagos State of Nigeria.”

 

However, the Court did not take his plea following a motion moved by the prosecutor, Mr. Lucky Ihiehie, asking the Court to give a date and refer the matter to the DPP for legal advice.

 

The Presiding Magistrate, Mrs. M.O. Tanimola, ordered his remand in custody at the correctional center at Kirikiri town, Lagos, pending the outcome of the DPP’s advice and directed the prosecutor to duplicate the file and send it to the DPP for legal advice.

 

The matter was adjourned for mention while the defendant was remanded in custody pending the outcome of the DPP’s advice, which will determine if the matter will be transferred to the High Court or not over jurisdiction.
