A 37-year old man, Olawale Oluwatobi, has landed in trouble in Lagos State after he tricked a 17-year old girl and had sex with her after fondling her breasts and getting her confused.
P. M. EXPRESS reports that the suspect, Oluwatobi, has been arrested and charged for defilement, which attracts several years of imprisonment or life imprisonment.
The incident happened on 4th June, 2023, at Abeni Balogun Street, U-turn Bus Stop, Ebule-Egba area of Lagos, where they reside.
The suspect, Oluwatobi, allegedly lured the girl into his apartment and tricked her into a sexual intercourse after having fondled her breasts in order to confuse her.
The girl later realised herself and reported to her parents that she was raped by Oluwatobi.
The alleged rape was reported to the Police and the suspect, Oluwatobi, was arrested and then detained for interrogation over the alleged rape.
While being interrogated, the suspect denied raping her and stated that he had sex with the girl with her consent but the victim insisted that she was raped.
The Police therefore, found Oluwatobi culpable and subsequently charged him before the Ogba Magistrate Court for defilement.
But when he was arraigned, the Court did not take his plea after the prosecutor, Inspector Ajayi Emmanuel, asked the Court to refer the matter to the DPP for legal advice since the allegation was a capital offence in the interest of justice.
The Presiding Magistrate, Mrs. O. O. Fagbohun, ordered the defendant to be remanded in custody pending the outcome of the DPP’s advice and as well directed the prosecutor to duplicate the file and send it to the DPP.
The matter was adjourned for the report of the DPP’s legal advice to be ready, which will determine if the matter will be transferred to the High Court or not over jurisdiction.
