P.M.EXPRESS reports that the incident happened at Adedayo Street, off Wazobia Bus Stop in Abaranje, Ikotun area of Lagos, where they reside.
The Police alleged the suspect, Taiwo, to have lured the girl into his apartment, indecently dealt with her by fondling her breasts and her private part. She became confused and was unable to resist his moves before he eventually penetrated her.
Having satisfied himself, he allowed her to go. It was then the girl regained herself, raised alarm and informed her parents that she was actually raped because she never consented to it.
The matter was reported to the Police and the suspect, Taiwo, was arrested. He was later transferred to the Gender Section of the Command for interrogation over his conduct, which contravened Child Rights Law of Lagos State.
During interrogation, he admitted to have slept with the girl but with her consent. But the girl insisted that she was lured into the act after he had confused her without her consent.
The Police found Taiwo culpable because the victim is still a minor and subsequently charged him before the Ogba Magistrates Court for the alleged offence.
When he was arraigned, the Court did not take his plea after the prosecutor, Mr. Lucky Ihiehie, asked the Court to refer the matter to the DPP for advice since the victim is still a minor.
The Presiding Magistrate, O.A. Layinka, ordered his remand in the Correctional Centre at Kirikiri town, Lagos, pending when the DPP’s report will be ready and directed the prosecutor to duplicate the file and send it to the DPP.
The matter was adjourned pending the outcome of DPP’s advice, which will determine if the matter will be transferred to the High Court or not over jurisdiction.
