MICHAEL AKINOLA

A 46-year old man, Kola Fasanya, has been arrested and charged in Lagos State for allegedly swindling a man,  Ayinde Sulaimon Damola, under the false pretence of selling a property but it turned out to be a scam.

P.M.EXPRESS reports that the property in question is located at Alakuko area of Lagos.

It was alleged that after the suspect, Kola, received the money, he bolted away, went into hiding and disconnected every communication he had with the complainant.

The matter was reported to the Police at the Commissioner of Police Monitoring Unit. The Police operatives moved into action, eventually arrested the suspect and detained him for interrogation over his alleged conduct.

While being interrogated, the suspect allegedly admitted to have collected the money, spent it and he had no money to refund as he had no property to sell to the complainant.

The Police found him culpable and charged him before the Ogba Magistrate Court for the alleged offence under the Criminal Laws of the State.

The charges read:

“That you, Kola Fasanya ‘m’ and others now at large, sometimes in November, 2023, at Alakuko area of Lagos State, in the Lagos Magisterial District did conspire amongst yourse/ves to commit felony to wit obtaining money under false pretense, and thereby committed an offence punishable under Section 411 of the criminal law of Lagos State, Nigeria 2015.”

COUNT II:”That you, Kola Fasanya ‘m’ and others now at large, on the same date, time and place, in the aforementioned Magisterial District, did fraudulently obtain the sum of Twenty Five Million Naira (N25,000,000.00) from one Ayinde Sulaimon Damola ‘m’ with the pretense of selling a property located at Alakuko area of Lagos, a representation you knew to be false, and thereby committed an offence punishable under Section 314 of the criminal law of Lagos of Nigeria, 2015.”

COUNT III:” That you, Kola Fasanya ‘m’ and others now at large, on the same date, time and place, in the aforementioned Magisterial District, did steal Twenty Five Million Naira (N25,000,000.00) property of one Ayinde Sulaimon Damola ‘m’ and thereby committed an offence punishable under section 287 of Nigeria, 2015.”

However, he pleaded not guilty to the three counts charges.

The prosecutor, Supol Akeem Raji, then asked the Court to give a date for hearing since he pleaded not guilty to enable the Police to prove that he actually committed the alleged offence.

The Presiding Magistrate, Mrs. O. Kusanu, granted him bail with two sureties, who must show evidence of means of livelihood and tax payment while addresses will be verified by the Court.

The matter was adjourned for mention while the defendant was remanded in custody at the correctional center at Kirikiri town, Lagos, pending when he will perfect his bail conditions.
