A 52-year-old man, Emmanuel Orekoya, has been arrested in Lagos State for allegedly inserting finger into his 17-year old Daughter’s private part and eventually raping her.
P.M.EXPRESS reports that the incident took place on Jacob Adeleye Street, Odo-Eran, Itire area of Lagos, where they reside.
Having been found culpable by the Police after his arrest and interrogation, he was brought before an Ebute Metta Magistrate’s Court for the alleged offence.
The defendant, Orekoya, was arraigned on two counts before the Court for unlawfully inserting his fingers into the private part of the daughter and having carnal knowledge of her.
When he was arraigned, the prosecutor, Inspector Osagiede Orobosa, told the Court that the defendant committed the alleged offence at his residence, where the victim lives with him.
The charges read in part, “That you, Emmanuel Orekoya, of Jacob Adeleye Street, Odo-Eran, Itire, within the Lagos Magisterial District, did unlawfully have carnal knowledge of your daughter (name withheld) by inserting your manhood into her private parts, thereby committing an offence contrary to and punishable under Section 137 of the Criminal Law of Lagos State of Nigeria, 2015″.
The Court did not take his plea following a motion moved by the prosecutor, Orekoya, asking the Court to refer the matter to the DPP because of the nature of the matter.
The Chief Magistrate, Folarin Williams, ordered that Orekoya be remanded in custody pending legal advice from the Directorate of Public Prosecutions (DPP ) and directed the prosecutor to duplicate the file and send it to the DPP for advice.
The matter was adjourned till Monday 16th January, 2023, for mention for the report of the DPP’s advice to be available, which will determine if the matter will be transferred to the High Court or not over jurisdiction.
