Man, 55, Arrested For Having Sex With Girl, 13, At Cemetery

A 55-year old man, Rafiu Sanusi, has been arrested for allegedly sleeping with a 13-year old girl at Cemetery Road, Amukoko area of Lagos, where they reside.

P.M.EXPRESS reports that the suspect, Sanusi, reportedly lured the victim, got her confused before engaging her in sex romp. The Police did not state if Sanusi had a wife or was living alone where he sexually molested the victim.

They were reportedly caught after the act and Sanusi was handed over to the Police in the area. From there, he was transferred to the Gender Section of the Police Command, Ikeja, Lagos.

During interrogation, Sanusi reportedly admitted that he actually had sex with the victim adding that he did not force her into the act. But the victim claimed that she was forced into it after he lured her, removed her pant and penetrated her.

The Police found Sanusi culpable and later charged him before the Ogba Magistrates Court for defilement which attracts several years of imprisonment if he is tried and found guilty before the Court.
However, during his arraignment, the Court did not take his plea after the prosecutor, Mr. Christopher John, asked the Court to refer the matter to the DPP for advice because the victim was still a minor.
Thus, the Presiding Magistrate, Mr. P.E Nwaka, ordered him to be remanded in prison custody without an option of bail.
The Court also directed the prosecutor to duplicate the file and send to the DPP for advice. The matter was adjourned till 15th November, 2019, for the report of the DPP to be available.
The matter may be transferred to the High Court if the DPP finds the man, Sanusi, culpable and recommends that he should be tried for the alleged offence.
