A 70-year man, Afolabi Michael, has been ordered to be remanded in prison custody for allegedly severally engaging his neighbour’s 11-year old girl in sex before the victim eventually exposed him.
P.M.EXPRESS reports that the order was made following his arraignment before the Ogba Magistrate Court for defilement of the victim by the Presiding Magistrate, Mrs. E. Kubenije, over his alleged conduct.
The incident happened at Fatimo Street, Iju area of Lagos, where they reside.
According to the Police, the man had severally lured the victim into his apartment, engaged her in the act on multiple occasions and warned her not to tell anyone about it.
However, when the victim could no longer bear the trauma, she revealed what had been happening to her parents and the matter was reported to the Police in the area.
The man was arrested and transferred to the Gender Section of the State Police Command for interrogation over his alleged conduct.
During interrogation at the Gender Section, the man was said to have admitted doing so but with the victim’s consent and as such he did not force her as claimed by the victim.
However, the Police found him culpable and charged him before the Court for the alleged offence which attracts several years of imprisonment.
The Court did not take his plea when he was arraigned after the prosecutor, Inspector John Iberedem, asked the Court to refer the matter to the DPP for legal advice because of the nature and seriousness of the alleged offence.
The Presiding Magistrate, Mrs. E. Kubeinje, ordered his remand in custody at the correctional center at Kirikiri town, Lagos, pending the outcome of the DPP’s legal advice and directed the prosecutor to duplicate the file and send it to the DPP.
The matter was adjourned till 13th November, 2024, for mention for the report of the DPP’s advice to be available, which will determine if the matter will be transferred to the High Court or not over jurisdiction.
