NSC Chairman Shehu Dikko’s Declaration Of PFAN As The Players’ Union In Nigeria: What The Law Says, What FIFPRO Requires – And Where Does It Leave The Player?

𝐏𝐀𝐑𝐓 𝟏 𝐎𝐅 𝟐

Nigeria’s long-running players’ union question returned sharply to the foreground following a 𝐒𝐞𝐩𝐭𝐞𝐦𝐛𝐞𝐫 𝟏𝟒, 𝟐𝟎𝟐𝟔 meeting involving representatives of the players’ bloc and the 𝐍𝐚𝐭𝐢𝐨𝐧𝐚𝐥 𝐒𝐩𝐨𝐫𝐭𝐬 𝐂𝐨𝐦𝐦𝐢𝐬𝐬𝐢𝐨𝐧.

𝐓𝐡𝐞 𝐒𝐮𝐧, reporting on 𝐒𝐞𝐩𝐭𝐞𝐦𝐛𝐞𝐫 𝟐𝟐, said NSC Chairman 𝐌𝐚𝐥𝐥𝐚𝐦 𝐒𝐡𝐞𝐡𝐮 𝐃𝐢𝐤𝐤𝐨 told the players’ bloc that the 𝐏𝐫𝐨𝐟𝐞𝐬𝐬𝐢𝐨𝐧𝐚𝐥 𝐅𝐨𝐨𝐭𝐛𝐚𝐥𝐥𝐞𝐫𝐬 𝐀𝐬𝐬𝐨𝐜𝐢𝐚𝐭𝐢𝐨𝐧 𝐨𝐟 𝐍𝐢𝐠𝐞𝐫𝐢𝐚, 𝐏𝐅𝐀𝐍, was the “𝐨𝐧𝐥𝐲 𝐛𝐨𝐝𝐲 𝐥𝐞𝐠𝐚𝐥𝐥𝐲 𝐫𝐞𝐜𝐨𝐠𝐧𝐢𝐬𝐞𝐝” to work with the NSC and the 𝐍𝐢𝐠𝐞𝐫𝐢𝐚 𝐅𝐨𝐨𝐭𝐛𝐚𝐥𝐥 𝐅𝐞𝐝𝐞𝐫𝐚𝐭𝐢𝐨𝐧.

The report said 𝐃𝐢𝐤𝐤𝐨 grounded that position in the 𝐍𝐚𝐭𝐢𝐨𝐧𝐚𝐥 𝐒𝐩𝐨𝐫𝐭𝐬 𝐂𝐨𝐦𝐦𝐢𝐬𝐬𝐢𝐨𝐧 𝐄𝐬𝐭𝐚𝐛𝐥𝐢𝐬𝐡𝐦𝐞𝐧𝐭 𝐀𝐜𝐭 𝟐𝟎𝟐𝟑, maintained that the 𝐍𝐒𝐂 and 𝐍𝐅𝐅 could not work outside the law, and urged the different groups to close ranks under 𝐏𝐅𝐀𝐍.

𝐍𝐞𝐰 𝐓𝐞𝐥𝐞𝐠𝐫𝐚𝐩𝐡 also reported the meeting and traced the detailed account to 𝐏𝐫𝐢𝐧𝐜𝐞 𝐇𝐚𝐫𝐫𝐢𝐬𝐨𝐧 𝐉𝐚𝐥𝐥𝐚, Chairman of PFAN’s Board of Trustees.

That deserves careful consideration because several different forms of recognition have become intertwined in the Nigerian debate.

The public record needs to be separated carefully: 𝐬𝐭𝐚𝐭𝐮𝐭𝐨𝐫𝐲 𝐫𝐞𝐜𝐨𝐠𝐧𝐢𝐭𝐢𝐨𝐧, 𝐭𝐫𝐚𝐝𝐞-𝐮𝐧𝐢𝐨𝐧 𝐫𝐞𝐠𝐢𝐬𝐭𝐫𝐚𝐭𝐢𝐨𝐧, 𝐨𝐫𝐠𝐚𝐧𝐢𝐬𝐚𝐭𝐢𝐨𝐧𝐚𝐥 𝐡𝐢𝐬𝐭𝐨𝐫𝐲 and 𝐢𝐧𝐭𝐞𝐫𝐧𝐚𝐭𝐢𝐨𝐧𝐚𝐥 𝐩𝐥𝐚𝐲𝐞𝐫 𝐫𝐞𝐩𝐫𝐞𝐬𝐞𝐧𝐭𝐚𝐭𝐢𝐨𝐧 each arise from different frameworks.

Understanding those distinctions is essential to understanding what the current record actually establishes.

𝐖𝐇𝐀𝐓 𝐓𝐇𝐄 𝐍𝐒𝐂 𝐀𝐂𝐓 𝐏𝐑𝐎𝐕𝐈𝐃𝐄𝐒

Section 𝟐(𝟏)(𝐨) of the 𝐍𝐚𝐭𝐢𝐨𝐧𝐚𝐥 𝐒𝐩𝐨𝐫𝐭𝐬 𝐂𝐨𝐦𝐦𝐢𝐬𝐬𝐢𝐨𝐧 𝐀𝐜𝐭 𝟐𝟎𝟐𝟑 expressly provides for:

“𝐚 𝐫𝐞𝐩𝐫𝐞𝐬𝐞𝐧𝐭𝐚𝐭𝐢𝐯𝐞 𝐨𝐟 𝐏𝐫𝐨𝐟𝐞𝐬𝐬𝐢𝐨𝐧𝐚𝐥 𝐅𝐨𝐨𝐭𝐛𝐚𝐥𝐥𝐞𝐫𝐬 𝐀𝐬𝐬𝐨𝐜𝐢𝐚𝐭𝐢𝐨𝐧 𝐨𝐟 𝐍𝐢𝐠𝐞𝐫𝐢𝐚.”

The statutory position is clear: 𝐏𝐅𝐀𝐍 is the players’ body specifically named for representation on the 𝐍𝐚𝐭𝐢𝐨𝐧𝐚𝐥 𝐒𝐩𝐨𝐫𝐭𝐬 𝐂𝐨𝐦𝐦𝐢𝐬𝐬𝐢𝐨𝐧.

That provides the legal basis for the position attributed to NSC Chairman 𝐒𝐡𝐞𝐡𝐮 𝐃𝐢𝐤𝐤𝐨 concerning PFAN’s relationship with the Commission.

The broader question of player representation also touches other legal and institutional frameworks.

Trade-union registration falls within Nigeria’s labour-law structure, while international representation through 𝐅𝐈𝐅𝐏𝐑𝐎 is governed by FIFPRO’s own statutes, membership procedures and standards.

These frameworks address different aspects of representation.

𝐍𝐀𝐍𝐏𝐅’𝐒 𝐓𝐑𝐀𝐃𝐄-𝐔𝐍𝐈𝐎𝐍 𝐑𝐄𝐂𝐎𝐑𝐃

The 𝐍𝐚𝐭𝐢𝐨𝐧𝐚𝐥 𝐀𝐬𝐬𝐨𝐜𝐢𝐚𝐭𝐢𝐨𝐧 𝐨𝐟 𝐍𝐢𝐠𝐞𝐫𝐢𝐚 𝐏𝐫𝐨𝐟𝐞𝐬𝐬𝐢𝐨𝐧𝐚𝐥 𝐅𝐨𝐨𝐭𝐛𝐚𝐥𝐥𝐞𝐫𝐬, 𝐍𝐀𝐍𝐏𝐅, also has a documented history within Nigeria’s labour-law framework.

A 𝐃𝐚𝐢𝐥𝐲 𝐒𝐩𝐨𝐫𝐭𝐬 report published on 𝐃𝐞𝐜𝐞𝐦𝐛𝐞𝐫 𝟐𝟐, 𝟐𝟎𝟏𝟓 recorded that the Office of the Registrar of Trade Unions had issued correspondence dated 𝐃𝐞𝐜𝐞𝐦𝐛𝐞𝐫 𝟏𝟕, reference 𝐌𝐋.𝐈𝐓𝐔/𝟏𝟑𝟖/𝐈/𝟏𝟓𝟐.

According to that contemporaneous report, Registrar of Trade Unions 𝐌𝐫𝐬. 𝐍. 𝐌𝐛𝐨𝐠𝐮 presented the organisation with a Letter of Approval, Certificate of Registration and certified constitution after completion of the registration process under the Trade Unions Act.

The report quoted the Registrar as describing NANPF as a registered “𝐔𝐧𝐢𝐨𝐧 𝐨𝐟 𝐖𝐨𝐫𝐤𝐞𝐫𝐬.”

By 𝟐𝟎𝟏𝟖, NANPF was publicly operating under former international 𝐃𝐚𝐡𝐢𝐫𝐮 𝐒𝐚𝐝𝐢, with 𝐀𝐮𝐬𝐭𝐢𝐧 𝐏𝐨𝐩𝐨 serving as secretary.

That record establishes NANPF’s historical position within the trade-union framework, just as the NSC Act establishes PFAN’s statutory position within the Commission.

The two records arise from different legal structures and should be read within those respective contexts.

𝐓𝐇𝐄 𝐒𝐄𝐀𝐑𝐂𝐇 𝐅𝐎𝐑 𝐎𝐍𝐄 𝐕𝐎𝐈𝐂𝐄

Nigeria’s players’ union history did not remain divided neatly between those two positions.

Public records show repeated efforts to reconcile the competing organisations.

A particularly significant process began in 𝐉𝐮𝐥𝐲 𝟐𝟎𝟐𝟎, when 𝐍𝐀𝐍𝐅 and 𝐍𝐀𝐍𝐏𝐅 publicly announced moves toward unity and established a committee to work toward a harmonised players’ body.

By 𝐍𝐨𝐯𝐞𝐦𝐛𝐞𝐫 𝟐𝟎𝟐𝟎, a unified structure had emerged under former Super Eagles international 𝐓𝐢𝐣𝐚𝐧𝐢 𝐁𝐚𝐛𝐚𝐧𝐠𝐢𝐝𝐚.

Reporting at the time identified a Board of Trustees that brought together figures from the previously divided groups, including 𝐇𝐚𝐫𝐫𝐢𝐬𝐨𝐧 𝐉𝐚𝐥𝐥𝐚, 𝐀𝐮𝐬𝐭𝐢𝐧 𝐏𝐨𝐩𝐨 and 𝐃𝐚𝐡𝐢𝐫𝐮 𝐒𝐚𝐝𝐢.

𝐏𝐅𝐀𝐍 subsequently described the 𝟐𝟎𝟐𝟎 𝐌𝐞𝐦𝐨𝐫𝐚𝐧𝐝𝐮𝐦 𝐨𝐟 𝐔𝐧𝐝𝐞𝐫𝐬𝐭𝐚𝐧𝐝𝐢𝐧𝐠 as the agreement that produced the unified organisation.

However, the public record did not remain settled.

𝐍𝐀𝐍𝐏𝐅 has since publicly challenged whether the merger was implemented according to the terms originally agreed and has disputed aspects of PFAN’s account of how the unified structure ultimately emerged.

The record therefore shows both a documented reconciliation and merger process and a continuing disagreement over its implementation and effect.

𝐖𝐇𝐀𝐓, 𝐓𝐇𝐄𝐍, 𝐇𝐀𝐒 𝐁𝐄𝐄𝐍 𝐒𝐄𝐓𝐓𝐋𝐄𝐃?

Three facts can stand together without contradiction.

𝐏𝐅𝐀𝐍 is expressly named in the 𝐍𝐚𝐭𝐢𝐨𝐧𝐚𝐥 𝐒𝐩𝐨𝐫𝐭𝐬 𝐂𝐨𝐦𝐦𝐢𝐬𝐬𝐢𝐨𝐧 𝐀𝐜𝐭.

𝐍𝐀𝐍𝐏𝐅 has a documented trade-union registration history.

And Nigeria’s players’ organisations undertook a substantial reconciliation and merger process in 𝟐𝟎𝟐𝟎 whose continuing effect remains disputed in the public record.

That is where the domestic record presently leaves the matter.

But Nigerian football does not operate only within Nigerian institutions.

Professional players compete within a global employment system. Their contracts cross borders. Their disputes may reach international tribunals. Their collective rights increasingly form part of football’s international governance structure.

So one further question follows:

𝐈𝐟 𝐭𝐡𝐞 𝐞𝐯𝐞𝐧𝐭𝐮𝐚𝐥 𝐝𝐞𝐬𝐭𝐢𝐧𝐚𝐭𝐢𝐨𝐧 𝐢𝐬 𝐫𝐞𝐜𝐨𝐠𝐧𝐢𝐬𝐞𝐝 𝐢𝐧𝐭𝐞𝐫𝐧𝐚𝐭𝐢𝐨𝐧𝐚𝐥 𝐫𝐞𝐩𝐫𝐞𝐬𝐞𝐧𝐭𝐚𝐭𝐢𝐨𝐧 𝐨𝐟 𝐍𝐢𝐠𝐞𝐫𝐢𝐚𝐧 𝐩𝐫𝐨𝐟𝐞𝐬𝐬𝐢𝐨𝐧𝐚𝐥 𝐟𝐨𝐨𝐭𝐛𝐚𝐥𝐥𝐞𝐫𝐬, 𝐰𝐡𝐨𝐬𝐞 𝐬𝐭𝐚𝐧𝐝𝐚𝐫𝐝𝐬 𝐝𝐞𝐭𝐞𝐫𝐦𝐢𝐧𝐞 𝐭𝐡𝐚𝐭 𝐝𝐞𝐬𝐭𝐢𝐧𝐚𝐭𝐢𝐨𝐧?

That leads directly to 𝐅𝐈𝐅𝐏𝐑𝐎.

And it is there that the discussion moves from domestic recognition to the standards governing international player representation.
