A 16-year old boy, Tosin Oloyede, may likely spend the rest of his life in prison over alleged defilement of his neighbour’s 5-year old girl during the just concluded Presidential and National Assembly elections in Lagos State.
P.M.EXPRESS reports that he was arrested and arraigned before the Court for the alleged offence.
The Presiding Magistrate at the Ogba Magistrates Court, Mrs. B. O. Osunsanmi, where Oloyede was arraigned, has ordered his remand at the Special Correctional Centre for Boys in Oregun pending legal advice from the Directorate of Public Prosecution (DPP).
This followed a motion moved by the prosecutor, Supol Akeem Raji, asking the Court to refer the matter to the DPP for advice since both the defendant and victim are still minors.
The prosecutor told the Court that the suspect committed the crime on Saturday, 25th February, 2023, around 2 pm in the Ikorodu area of Lagos State.
”Oloyede defiled the victim by having sexual intercourse with her,” the prosecutor stated.
Supol Raji stated that the offence committed contravened Section 27 and is punishable under Section 210 (8) of the Child Right Law of Lagos State 2015.
The Investigating Police Officer, Inspector Esther Igbineweka, also told the Court that the defendant made a confessional statement at the Igbogbo Police Station when the parents first reported the matter before he was transferred to the Gender Section of the Lagos State Command, where he also made a confessional statement.
According to the Police, the girl’s parents went to vote on the election day and the defendant sneaked into their apartment. In the process, he defiled the girl but was caught in the act by the victim’s brother, who informed the parents.
The Presiding Magistrate, Mrs. B.O. Osunsanmi, ordered his remand in custody pending the outcome of the DPP’s report and directed the prosecutor to duplicate the file and send it to the DPP.
The matter was adjourned till 12th April, 2023, for the DPP’s legal advice to be available, which will determine if the matter will be transferred to the High Court or not over jurisdiction.
