KINGSLEY EBERE

A 42-year old man, Johnpaul Pius, has been arrested and charged for allegedly killing another man, Victor Bassey Asanga, 43, by shooting him with a gun during a squabble.

P.M.EXPRESS reports that the incident happened on 20th July, 2024, at Aka Road, Okokomaiko area of Lagos.

The suspect was said to have shot the victim on the chest and he was rushed to an undisclosed hospital, where the Doctor confirmed him dead and his corpse was deposited at mortuary for autopsy reports.

The matter was reported to the Police. The Police moved into action, eventually arrested the suspect and detained him for interrogation over his alleged conduct.

After rounds of interrogation, the Police found him culpable for willfully killing the victim by shooting him over an undisclosed matter. He was consequently charged before the Yaba Magistrate Court for the alleged murder under the Criminal Laws of the State.

Part of the charges read:

That you, JohnPaul Pius ‘M’, on the 20th day of July, 2024 at about 2150hrs, at No. 11 Aka Road Okokomaiko Lagos, in the Lagos Magisterial District, did conspire amongst yourself to commit felony to wit: Murder and thereby, committed an offence punishable under Section 233 of the Criminal Law of Lagos State, 2015.”

COUNT II:That you, Johnpaul Pius, on the 20th day of July, 2024 at about 2150hrs, at No. 11 Aka Road Okokomaiko Lagos, in the Lagos Magisterial District, did unlawfully kill one Victor Bassey Asanga ‘M’ aged 43 years by shooting him with a gun on the left side of his chest and thereby, committed an offence punishable under Section 223 of the Criminal Law of Lagos State, 2015.”

However, the Court did not take his plea when he was arraigned following a motion moved by the prosecutor, Supol Thomas Nurudeen, asking the Court to refer the matter to the DPP for advice.

The Presiding Magistrate, Mr. P.E. Nwaka, ordered his remand in custody pending the outcome of the DPP’s legal advice and directed the prosecutor to duplicate the file and send it to the DPP.

The matter was adjourned for mention for the report of the DPP’s advice to be available, which will determine if the matter will be transferred to the High Court or not over jurisdiction.
