A 47-year old man, Olayemi Kehinde, has been arrested and charged for allegedly engaging a 13-year old girl in sex after Inserting his finger into her private part and getting her confused.
P.M.EXPRESS reports that the incident happened at Sapati Baale Street, Ibeju-Lekki area of Lagos, where they reside.
According to the Police, the suspect lured the victim into his apartment, inserted his finger into her private part and got her confused before he eventually penetrated her.
However, after the act, the victim informed her parents about what happened and how Kehinde lured her into his apartment and forcefully engaged her in sex without her consent.
The matter was reported to the Police at Elemoro Division and Kehinde was arrested. He was later transferred to the SCID, Yaba, for further investigation. At the SCID, he reportedly admitted to have had sex with her but with her consent.
However, the Police found him culpable because the victim is still a minor and consequently charged him before the Yaba Magistrate Court for the alleged offence, which contravened Sections 137 and 263 of the criminal code and attracts several years of imprisonment.
The Court did not take his plea when he was arraigned following a motion moved by the prosecutor, Supol Thomas Nurudeen, asking the Court to refer the matter to the DPP for legal advice.
Thus, the Presiding Magistrate, Mr. P.E. Nwaka, ordered his remand in custody at the Correctional Centre pending the outcome of the DPP’s advice and directed the prosecutor to duplicate the file and send it to the DPP.
The matter was adjourned for mention for the report of the DPP’s advice to be available, which will determine if the matter will be transferred to the High Court or not over jurisdiction.
