A 20-year old man, Wasiu Toheeb, has been arrested for allegedly biting a 40-year old woman to submission and forcefully engaged her in sex.
P.M.EXPRESS reports that the incident happened on 18th September, 2022, about 1.00pm at Omi-Adio area of Ibadan, Oyo State, where they reside.
He has been charged before the Iyaganku Magistrates Court sitting in Ibadan and remanded in the Correctional Centre for statutory rape.
The defendant, Toheeb, whose residential address was not disclosed by the Police ,was charged for rape, assault and theft.
When he was arraigned, the prosecutor, Inspector Gbemisola Adedeji, told the Court that the defendant raped his victim and assaulted her by biting her all over the body, causing her grievous bodily harm before he subdued her and forcefully engaged her in sex.
Thereafter, Toheeb was said to have stolen a pair of earrings worth N5,000 and cash of N7,500, from the victim before he allowed her to go.
The matter was reported to the Police, who trailed and eventually arrested him before he was charged to Court for the alleged offence, which contravened Sections 358, 355 and 390(9) of the Criminal laws of Oyo State, 2000.
However, he pleaded not guilty.
The Magistrate, Mrs. S. A. Adesina, did not take the plea of the defendant after the prosecutor moved a motion asking the Court to refer the matter to the DPP over jurisdiction.
Thus, the Presiding Magistrate directed the prosecutor to duplicate the file and send it to the Oyo State Director of Public Prosecutions for advice.
The matter was adjourned till 24th November, 2022, for mention, for the report of the DPP’s advice to be available, which will determine if the matter will be transferred to the High Court or not over jurisdiction.
