I Had Easy Penetration – Says Man, 47, Caught Having S*x With Girl, 12

A 47-year old man, Israel Chukwuka, who was arrested in Lagos State over sex with a 12-year old, has told the Police that it was not a case of rape as he had an easy penetration during the romp and it was done on mutual agreement.
The incident happened at Ore Ofe Street, Cele Bus Stop, Ishashi area of Lagos, where they reside.
The Police alleged that the suspect, Chukwuma, lured the victim to his apartment and engaged her in sex. But he was caught in the act and handed over to the Police in the area. He was however, transferred to the Gender Section of the Command for interrogation over the conduct.
During the interrogation, Chukwuka denied insisting that he did it with the consent of the victim despite the fact he knew that the victim is still a minor in the eyes of the Law.
The Police then charged him before the Ogba Magistrates Court for the alleged offence. But the Court did not take his plea following a motion moved by the prosecutor, Supol Akeem Raji asking the Court to refer the matter to the DPP for advice.
Thus, the Presiding Magistrate, Mrs. B.O. Osunsanmi ordered him to be remanded in Correctional Centre at Kirikiri town, Lagos, pending the outcome of the DPP’s advice and directed the prosecutor to duplicate the file and send it to the DPP.
The matter was adjourned till 19th October, 2022, for the report of the DPP to be available, which will determine if the matter will be transferred to the High Court or not over jurisdiction.
