A 50-year old man, Peter Oyeleke, has been arrested and charged in Lagos State for allegedly defiling his 10-year old daughter.
P.M.EXPRESS reports that the incident happened at Wasin Avenue, Rogo Bus Stop, Iju Ishaga area of Lagos, where they reside.
The man has been charged before the Court for defilement under Section 137 of the Criminal Laws of the State.
The Police alleged that the man lured the victim some time in June 2023 during her school’s mid-term break when other members of the family including her mother was not around and forcefully had carnal knowledge of her.
Thereafter, he warned her not to tell anyone about what happened having satisfied himself and allowed her to go.
However, the victim informed her mother about what happened and the matter was reported to the Police in the area.
The man, Oyeleke, was arrested and later transferred to the Gender Section of the State Police Command for interrogation over his alleged conduct.
After rounds of interrogation, the Police found him culpable and subsequently charged him before the Ogba Magistrate Court for the alleged offence, which attracts several years of imprisonment or life imprisonment.
When he was arraigned, the Court did not take his plea following a motion moved by the prosecutor, DSP Kehinde Ajayi, asking the Court to refer the matter to the DPP for legal advice.
Thus, the Presiding Magistrate, Mrs. E. Kubenije, ordered his remand in custody at the Correctional Centre at Kirikiri town, Lagos, pending the outcome of the DPP’s advice.
The Court also directed the prosecutor to duplicate the file and send it to the DPP because of the nature of the alleged offence, which attracts capital punishment.
The matter was adjourned till 30th October, 2023, for mention for the report of the DPP’s advice to be ready, which will determine if the matter will be transferred to the High Court or not over jurisdiction.
