A 28-year old man, Samuel Uche Oguwie, has landed in trouble in Lagos State for allegedly engaging a 14- year old girl in sex after sucking her breasts, getting her confused and she was unable to resist him.
P.M.EXPRESS reports that the incident happened on 23rd August, 2023, at Maryland area of Lagos, where they reside.
The suspect, Oguwie, has been charged before a Court in Lagos for defilement, which attracts several years of imprisonment or life imprisonment.
The Police alleged that the suspect lured the girl to his apartment, used words of mouth to confuse her before he fondled and sucked her breasts, which got her more confused and unable to resist him before he penetrated her.
Having satisfied himself, he allowed her to go but by then the girl had regained her senses, raised alarm and claimed that she was defiled by the suspect and then informed her parents.
The matter was reported to the Police at Ikeja Division. The suspect was arrested and detained at the station for interrogation over his alleged conduct.
During interrogation, the suspect claimed that he did not force her into the act and he did it with her consent which the victim denied and insisted that he raped her.
However, the Police found him culpable because the victim is still a minor and charged him before the Ogba Magistrate Court for the alleged defilement.
When he was arraigned, the Court did not take his plea following a motion moved by the prosecutor, Supol Akeem Raji, asking the Court to refer the matter to the DPP for legal advice because of the nature of the crime.
Thus, the Presiding Magistrate, Mrs. B.O Osunsanmi, ordered his remand in custody at the Correctional Centre at Kirikiri town, Lagos, pending the outcome of the DPP’s advice and directed the prosecutor to duplicate the file and send to DPP for advice.
The matter was further adjourned for mention for the report of DPP advice, which will determine if the matter will be transferred to the High Court or not over jurisdiction.
