Tenant Docked For Calling His Landlord A Thief In Public

A tenant, Smith Tosin, has been arrested and charged in the Federal Capital Territory, Abuja, for allegedly attacking his landlord, Chucks Nwado, calling him a thief and assaulting him in public.
P.M.EXPRESS reports that the incident happened on 29th May, 2024, at Liberty Junction, Byazhin, Kubwa, Abuja.
He has been charged before the Kubwa Magistrate Court, in Abuja, for allegedly assaulting his landlord on three count charges for defamation and assault.
The defendant, Tosin, who resides at Hill Top, Byazhin, however, pleaded leaded not guilty.
The prosecution counsel, John Okpala, told the Court that the defendant dragged his landlord, Chuks Nwado, by the shirt without any provocation and called Nwado a thief in public.
The offence, he said, contravened the provisions of Sections 265 and 392 of the Penal Code.
The defence counsel, Lilian Ibrahim, pleaded with the Court to grant the defendant bail citing Section 158,162 of the Administration of Criminal Justice Act (ACJA), and 36(5) of the 1999 constitution.
Ibrahim urged the Court to exercise its discretion judiciously and judicially in the defendant’s favour by admitting him to bail.
The Presiding Magistrate, Oyepeju Mustapha, admitted the defendant to bail in the sum of N100,000 with two sureties in like sum, who must show evidence of means of livelihood.
The Court also ordered that the sureties must reside within the Court’s jurisdiction, have sustainable means of livelihood and their addresses must be verified by the Court’s registrar.
The matter was adjourned till 8th July, 2024, for hearing while the defendant was remanded in custody at the correctional center pending when he will perfect his bail conditions.
