Court Dissolves 14-Year Old Marriage Over Wife’s Inability To Bear Child

A Customary Court in Jikwoyi, Abuja, Federal Capital Territory (FCT), has dissolved the 14-year old marriage between Maxwell Chuka and his wife, Christy, over the woman’s inability to bear a child for the husband. 
P.M.EXPRESS reports that this followed a suit filed before the Court by the husband, Maxwell, against his embattled wife, Christy on the grounds of childlessness.
The embattled wife, Christy consented to the dissolution of their marriage on the grounds that she has also lost interest in it.
“I am fed up with our marriage. I have tried my best to have children, but all attempts have failed. I have gone to different hospitals, taken different concoctions, all to no avail,” she said.
The embittered husband, Maxwell told the Court that since they have tried all they could do to bear a child and it did not work, it was better for the marriage to be dissolved so that they can go their separate ways in peace and he was ready to wave the pride price he had paid on her.
Delivering judgment, Malam Labaran Gusau dissolved their marriage on the grounds that both parties have lost interest in their union due to the wife’s barrenness.
“It is on record that both parties have consented to the dissolution of their marriage. The respondent has asked the Court to grant her husband’s prayer of divorce as well.”
“In view of this, the Court has no other choice than to dissolve their union.
“The petitioner has also waved the N25, 000 bride price he paid. Hence, the respondent has no need to return it,” Labaran said.
The marriage between Maxwell and Christy was subsequently dissolved.
