Man, 43, Docked For Engaging Biological Daughter, 15, In Sex

A 43-year old man, Samuel Ojo, has been arrested and charged for defilement in Lagos State after he allegedly engaged his biological 15-year old daughter in sex. 
P.M.EXPRESS reports that the incident happened at Community Road, Idimu area of Lagos, where they reside.
He has been charged before the Ogba Magistrate Court for incest and defilement over his conduct.
The matter was initially reported at Area M Command, Idimu. The Police operatives arrested the man and transferred him to the Gender Section of the State Police Command for further investigation over his alleged conduct.
After interrogation at the Gender Section, he was found culpable and charged accordingly.
The charge read:
That you, Samuel Ojo ‘m’ on the 20th Of June, 2024, at Community Road, Idimu, Lagos in the Lagos Magisterial District, did defile your daughter, by forcefully having sexual intercourse with her and thereby committed an offence punishable under Section 137 of the Criminal Law of Lagos State of Nigeria 2015.”
The second count charge read:
That you, Samuel Ojo, on the same date and place at the aforementioned magisterial district, did sexually assault your daughter by inserting your finger into her vagina and thereby committed an offence punishable under Section 261 of the Criminal Law of Lagos State of Nigeria 2015.”
The third Court stated: That you, Samuel Ojo, on the same date and place at the aforementioned Magisteria District did commit the offence of incest by having carnal knowledge of your daughter and thereby committed an offence punishable under Section 28 of the Lagos State Domestic & Sexual Violence Agency Law.”
The alleged offence attracts maximum sentence of life imprisonment.
However, the Court did not take his plea when he was arraigned following a motion moved by the prosecutor, Supol Akeem Raji, asking the Court to refer the matter to the DPP for legal advice.
Thus, the Presiding Magistrate, Mrs. B.O. Osunsanmi, ordered his remand in custody at the correctional center without an option of bail pending the outcome of the DPP’s advice and directed the prosecutor to duplicate the file and send it to the DPP.
The matter was adjourned till 5th August, 2024, for mention for the report of the DPP’s advice to be available, which will determine if the matter will be transferred to the High Court or not over jurisdiction.
