He Fondled My Breasts, Confused Me To Open My Legs – Says Girl, 16

A 16-year old girl, who was allegedly raped in Lagos by a 30-year old man, Ndubuisi Azuya, has revealed what transpired saying that the suspect fondled her breasts and confused her to open her legs.

The incident happened at Akinshina Street, Ade Ade Bus Stop, Abaranje area of Ikotun, Lagos, where they reside.

P.M.EXPRESS reports that the suspect, Azuya, was arrested by the Police from the Family Support Unit, Ikotun Division, over the defilement of the victim after reportedly fondling her breasts and engaging her in sex romp.
It was gathered that Azuya allegedly lured the victim into his apartment, confused her by fondling her breasts, then removed her pant and engaged her in sex romp. Thereafter, she regained her senses and raised alarm that she was raped by the suspect.
During investigation, Azuya claimed that he actually slept with her but with her consent as the girl willingly opened her legs and he engaged her in sex romp.
However, the girl insisted that she was raped because she never consented to the act and was forced to into it by the suspect as he lured her into the act.
The Police found Azuya culpable because the victim was a minor and later charged him before the Ogba Magistrates Court for defilement which attracts several years of imprisonment if he is tried and found guilty before the Court.
The defendant was not granted bail as the Court ordered his remand in prison custody following the motion by the prosecutor, Christopher John, asking the Court to refer the matter to the DPP for advice.
The Presiding Magistrate, Mr. P.E Nwaka, accepted the motion and remanded the defendant in prison custody without an option of bail.
The Court also directed the prosecutor to duplicate the file and send to the DPP for advice.
The matter was adjourned till 4th November, 2019, for the report of the DPP’s advice to be ready.

P.M.EXPRESS gathered that the matter may be transferred to the High Court if the DPP’s report finds him culpable and recommends that he should be tried for defilement.
