Two brothers of the same parents, aged 10 and 15, may spend the rest of their lives in custody over the alleged sex with their neighbour’s 4-year old girl in Lagos State as they were caught in the act by the victim’s parents.
P.M.EXPRESS reports that the incident happened at Toyin Davis Street, Ejigbo area of Lagos, where they reside.
Police operatives at State Criminal Investigation Department, Yaba, Lagos, have arrested the suspects.
Their arrest followed after a non-governmental organisation, known as Aunt Landa’s Bethel Foundation, wrote a petition to the Deputy Commissioner of Police at SCID, Yaba, over their conduct and they were subsequently arrested.
The suspects were alleged to have lured the victim and engaged her in sex romp one after the other before they were caught and handed over to the Police for prosecution despite their age.
After thorough interrogation, the Police found them culpable and subsequently charged them before the Yaba Magistrates Court for conspiracy and defilement.
However, when they were arraigned in Court, the prosecutor,  Supol Thomas Nurudeen, asked the Court to refer the matter to the DPP for advice since both the defendants and victim are still minors in the face of the law.
The Presiding Magistrate, Mr. P.E. Nwaka, ordered their remand at the Children’s Remand Home and directed the prosecutor to duplicate their file and send it to the DPP for advice.
The matter was adjourned pending outcome of the DPP’s advice, which will determine if the matter will be transferred to the High Court or not over jurisdiction.
Since both the defendants and victim are still minors, their identities were not disclosed in line with the policy of P.M.EXPRESS.
