2 Men Arraigned For Sexually Assaulting Girl, 8, By Finger Penetration

Two men, David Osigwe, 20 and Mamud Moses, 20, have been arrested and charged in Lagos State for sexually assaulting an 8-year old girl by penetrating her private part with their fingers. 

 

P.M.EXPRESS reports that the incident happened at Musilio Disu Street, Off Akesan Road, Igando, Lagos State, where they reside.

 

According to the Police, the suspects had sometime in 2024 lured the victim and sexually abused her by removing her pants and inserting their fingers into her private part.

 

After the ugly incident, the victim was said to have been emotional traumatized due to the sexual abuse but she later opened up to her parents about what she was passing through.

 

The matter was reported to the Police at Igando Division. The suspects were arrested and detained at the station for interrogation over the alleged offence.

 

After rounds of interrogation, the Police found them culpable and charged them before the Ogba Magistrate Court for the alleged offence, which attracts several years of imprisonment.

 

The charges read:

COUNT 1: “That you, David Osigwe and Mamud Moses, sometime in year 2024 at about unknown time at Musilio Disu Street, Off Akesan Roed, Igando, Lagos State, in the Lagos Magisterial District, did sexually assault the 8-year old victim by penetrating her vagina with your fingers and thereby committed an offence punishabte under Section 261 of the Child Rights Law of Legos State of Nigeria 2015.”

 

COUNT 11:”That you, David Osigwe and Mamud Moses, on the same date, time and place at the aforementioned Magisterial District, did unlawfully and indecently assault the victim, 8 years old and thereby committed an offence punishable under Section 135 (1) of Criminal Laws of Lagos State of Nigeria 2015.”

 

COUNT III:”That you, David Osigwe and Mamud Moses, on the same date, time and place at the aforementioned Magisterial District, did infringe on the right to dignity of the victim by subjecting her to mental or emotional injury and sexual abuse and thereby committed an offence contrary : CH-C7 10(1) (a) according to Child’s Rights laws of Lagos State of Nigerin 2015.”

 

However, the Court did not take their plea after the prosecutor, Inspector Lucky Ihiehie, moved a motion asking the Court to refer the matter to the DPP for legal advice.

 

The Presiding Magistrate, Mrs. M.O.Tanimola, ordered their remand in custody at the correctional center at Kirikiri town, Lagos, pending the outcome of the DPP’s advice and directed the prosecutor to duplicate the file and send it to the DPP for legal advice.

 

The matter was adjourned for mention for the report of the DPP’s advice to be available, which will determine if the matter will be transferred to the High Court or not over jurisdiction.
