A 21-year old man, Kowiu Babatunde, who was arrested in Lagos State after he was allegedly caught having sex with his neighbour’s 14-year old girl, has denied that it was a case of rape, stating that the penetration was so easy and the girl liked it because he did it with her consent.

P.M.EXPRESS reports that the incident happened at Ola Sende Crescent,  Shasha area of Lagos, where they reside.

The suspect, Babatunde, landed in trouble after he allegedly lured the girl to an apartment and engaged her in sex romp before he was caught in the act.

The girl’s parents, who were said to be very angry, went and reported the matter to the Police in the area. The Police then arrested Babatunde and transferred him to the Gender Section of the Command for interrogation over his conduct.

During interrogation, the suspect, Babatunde, reportedly admitted to have slept with her but denied any form of defilement via rape as claimed by the girl’s parents. He told the Police that it was an easy penetration because the girl consented to it and did not complain during the act.

However, the Police found him culpable because of the girl’s age as a minor and subsequently charged him before the Ogba Magistrates Court for defilement, which attracts several years of imprisonment if he is tried and found guilty before the Court.

When he was arraigned, the Court did not take his plea after the prosecutor,  DSP Kehinde Ajayi, asked the Court to refer the matter to the DPP for advice to determine the jurisdiction of the matter.
The Presiding Magistrate, Mrs. E. Kubeinje, ordered his remand in correctional center pending when the DPP’s report will be ready and directed the prosecutor to duplicate the file and send it to the DPP.

The matter was adjourned till 14th June, 2022, for the report of the DPP to be available, which will determine if the matter will be transferred to the High Court or not over jurisdiction.
