An 18-year old boy, Enoch Patrick, has landed in trouble in Lagos State after he was caught having sex with his 12-year old girlfriend as he has been arrested and charged before the Court.
P.M.EXPRESS reports that the boy, Patrick, has been charged before the Ogba Magistrate Court for defilement, which attracts several years of imprisonment or life imprisonment under the Criminal Laws of the State.
The incident happened at Raphael Ede Close, Comfort Oboh in Kirikiri area of Lagos, where they reside.
According to the Police, the boy, Patrick, lured the victim to an apartment and engaged her in sex. And while they were still in the act, they were caught by one of their neighbours, who raised alarm and the victim’s parents got to know about what happened.
They asked the victim what happened and she told them that she was lured into the act by the boy without her consent.
The matter was reported to the Police in the area and the boy was arrested. He was later transferred to the Gender Section of the State Police Command for interrogation over his alleged conduct.
During interrogation, he admitted to have slept with her as his girlfriend and with her consent. But that did not save him as the Police found him culpable and consequently charged him before the Court for the alleged offence.
However, the Court did not take his plea following a motion moved by the prosecutor, Supol Akeem Raji, asking the Court to refer the matter to the DPP for legal advice because of the nature of the alleged offence.
The Presiding Magistrate, Mrs. B.O. Osunsanmi, ordered his remand in the correctional centre at Kirikiri town, Lagos, pending the outcome of the DPP’s advice and directed the prosecutor to duplicate the file and send it to the DPP.
The matter was adjourned for mention while the defendant was remanded in custody pending the outcome of DPP’s advice, which will determine if the matter will be transferred to the High Court or not over jurisdiction.
