A 35-year old man, Tyozenda Theophilus, has landed in trouble in Lagos after he was allegedly caught having sex at night with a12-year old girl at a filling station.

P.M.EXPRESS reports that the incident happened at Agunmo Street besides the filling station in Awuwo at Oko-Afor area of Badagry Lagos where they reside.
It was gathered that Theophilus tricked lured the victim to the place at about 8pm, removed her pant and penetrated her before they were caught and handed over to the police.
The matter was later transferred to the Gender Section of the Police Command where he claimed that the victim was his lover and he made love to her.
However, the police found him culpable and charged him before the Ogba Magistrates Court for defilement.
The court did not take his plea and ordered that he be remanded in prison custody with an option of bail.
This was as a result of the motion raised by the prosecutor, Inspector Christopher John, asking the court to refer the matter to the DPP for advice.
Thus, the Presiding Magistrate, Mr. Peter Nwaka, directed the prosecutor to duplicate the file and send to the DPP for advice and adjourned the matter till 24th May, 2019.
P.M.EXPRESS gathered that the matter will be transferred to the High Court if the DPP finds Theophilus culpable and recommends his trial for the alleged offence.
