The Police alleged the suspect to have lured the girl into his apartment and penetrated her, having confused her with words of mouth while at the same time fondling her breasts and she could not resist the assault on her.

However, she later realized herself and raised an alarm, which prompted the arrest of the suspect, Ogala, by the Police in the area. The matter was transferred to the Gender Section of the Command for interrogation over the act.

After thorough interrogation, the Police found Ogala culpable and subsequently charged him before the Ogba Magistrates Court for the alleged offence.

When he was arraigned, the Court did not take his plea after the prosecutor, Supol Victor Eruada, asked the Court to refer the matter to the DPP for advice since the victim is still a minor.

The Presiding Magistrate, Mrs. M. O. Tanimola, ordered his remand in custody and directed the prosecutor to duplicate the file and send it to the DPP while the defendant will remain in custody pending the outcome of DPP’s report.

The matter may likely be transferred to the High Court if the DPP’s report finds the defendant culpable and recommends his trial for the alleged offence.
