Man, 31, In Police Net For Engaging Lady, 22, In S*x Under False Pretence

A 31-year old man, David Akaka, has been arrested in Lagos State over alleged rape after he was said to have lured a 22-year old lady and engaged her in sex under false pretence. 
 
P.M.EXPRESS reports that the incident happened at Oluyomi Crescent, Magodo area of Lagos State, where they reside.
The Police alleged that the suspect, David, lured the victim on 6th August, 2022, into his apartment and forcefully engaged her in the act without her consent. After the alleged dastardly act, the victim raised alarm and claimed that she was raped by the suspect.
The matter was reported to the Police in the area and David was arrested and later transferred to the Gender Section of the Lagos State Police Command for interrogation.
During interrogation, the suspect admitted to have slept with the victim but with her consent and that they never had any disagreement throughout the period it lasted.
Contrarily, the victim insisted that she was raped because she never consented to the act.
The Police found him David culpable and subsequently charged him before the Ogba Magistrates Court for the alleged offence, which attracts several years of imprisonment if he is found guilty before the Court.
However, the Court did not take David’s plea following a motion moved by the prosecutor, Supol Akeem Raji, asking the Court to refer the matter to the DPP for advice.
The Presiding Magistrate, Mrs. B.O. Osunsanmi, ordered his remand in the Correctional Centre at Kirikiri town, Lagos, pending when the DPP’s report will be ready and directed the prosecutor to duplicate the file and send it to DPP for advice.
The matter was adjourned till 19th October, 2022, for the report of the DPP’s advice to be available, which will determine if the matter will be transferred to the High Court or not over jurisdiction.
