A 35-year old man, Kayode Popoola, who was arrested in Lagos for allegedly sucking the breasts of a 17-year old girl, getting her confused and engaging her in sex romp, has insisted that it was not rape because the victim enjoyed It during the act.

P. M.EXPRESS reports that the incident happened on 5th May, 2022, at Adekunle Street, Oshodi area of Lagos, where they reside.

The suspect, Popoola, was alleged to have lured the victim into his apartment, used words of mouth to confused her, then fondled her breasts and she became more confused and was unable to resist the act in the process.

It was after the romp that the victim came to her senses. But by then Popoola had already satisfied himself and she raised alarm and claimed she was raped because he did it without her consent.

That marked the beginning of Popoola’s problem because the matter was reported to the Police and he was arrested. He was later transferred to the Gender Section of the Command for interrogation over the conduct.

During interrogation, Popoola denied to have raped her because he did it with her consent but the victim insisted that he lured her into it without her consent.

The Police found Popoola culpable because of the age of the victim and subsequently charged him before the Ogba Magistrates Court for statutory rape.  The alleged offence attracts several years of imprisonment if he is tried and found guilty before the Court.

When he was arraigned, the Court did not take his plea following a motion moved by the prosecutor,  DSP Kehinde Ajayi, asking the Court to refer the matter to the DPP for advice.

The Presiding Magistrate,  Mrs. E. Kubeinje, ordered his remand in the Correctional Centre without an option of bail pending when the DPP’s report will be ready.

The Court also directed the prosecutor to duplicate the file and send it to the DPP, while the matter was adjourned till 28th June, 2022, for the report of the DPP to be ready. The report will determine if the matter will be transferred to the High Court or not over jurisdiction.
