A 40-year old man, Ismaila Ganiyu, has landed in trouble after he allegedly lured a 16-year old girl into sex by fondling her breasts and getting her confused.

P.M.EXPRESS reports that the incident happened at Sule Street, Ijegun area of Lagos, where they reside.

The matter was reported to the Police at Ikotun Division and Ganiyu was arrested for indecent assault which is statutory rape and attracts several years of imprisonment if he is tried before the Court and found guilty.

P.M.EXPRESS gathered that the suspect, Ganiyu, allegedly lured the victim into his apartment, used words of mouth to confuse her before fondling her breasts and she got more confused. He then pulled her pant and penetrated her without resistance from her.

However, after the act, the victim realised herself and raised alarm that she was raped because she never consented to the act. But Ganiyu insisted that he did not forcefully penetrate her because she consented to it.

After interrogation, the Police found him culpable over the act because the victim was still a minor.He was then charged before the Ogba Magistrates Court for the alleged offence but the Court did not take his plea following the motion by the prosecutor, Supol Bisi Ogunleye, that the matter should be referred to the DPP for advice.

The Presiding Magistrate, Mrs. E. Kubunje, ordered him remanded in Correctional Centre and directed the Prosecutor to duplicate the file and send to the DPP for advice.
The matter was adjourned till 26th August, 2020, for report of the DPP’s advice to be available while the defendant, Ganiyu, will be in custody pending the outcome of DPP’s advice.
The matter may likely be transferred to the High Court if the DPP’s advice finds him culpable and recommends his trial for rape.
