Man, 46, Sent To Prison For Forcefully Penetrating Private Part Of Girl, 10

A 46-year old man, Smart Onyeacholem, has been remanded in prison custody in Lagos State for allegedly defiling a 10-year old girl by penetrating her private part with both his finger and dick. 

 

P.M.EXPRESS reports that the incident happened at Gbologe Street, Governor’s Road, Ikotun, Lagos where they reside.

 

According to the Police, the defendant lured the victim to his apartment, first used his finger to penetrate her private part to open it and thereafter penetrated her with his dick.

 

Having satisfied himself,  he allowed her to go. But the information leaked to the victim’s parents and the matter was reported to the Police at Ikotun Division. He was promptly arrested and detained at the station for interrogation over his alleged conduct.

 

After rounds of interrogation,  the Police found him culpable and charged him before the Ogba Magistrate Court for the alleged offence.

 

The Court did not take his plea when he was arraigned following a motion moved by  the Prosecutor, Supol Akeem Raji, asking the Court to refer the matter to the DPP for legal advice.

 

Thus, the Presiding Magistrate, Mrs. O. Kusanu, ordered his remand in custody at the correctional center at Kirikiri town, Lagos, pending the outcome of the DPP’s advice and directed the prosecutor to duplicate the file and send it to the DPP for legal advice.

 

The matter was adjourned for mention for the report of the DPP’s advice to be ready, which will determine if the matter will be transferred to the High Court or not over jurisdiction.

 

The charge read:

“That you, Smart Onyeacholem ‘M’ of Gbologe Street, Governor’s Road, Ikotun, Lagos, on 16/01/2025 between 2130hr to 2200hrs, in the Lagos Magisterial District, did defile the victim, 10years old by penetrating her private part with your finger and manhood and thereby committed an offence contrary to and punishable under Section 137, of the Lagos State Criminal Law, 2015.”
