Man, 62, Docked For Luring Lady, 20, Into Sex After Fondling Breasts

A 62-year old man, Olukayode  Oguntolu, has landed in trouble in Lagos State for allegedly luring a 20-year old lady into sex by fondling her breasts and she became confused.
P.M.EXPRESS reports that the lady reported to the Police that she was raped. The suspect, Oguntolu, was arrested and charged over his alleged conduct.
The incident happened at Oloruntobi Street, Fatoki Egan Igando, Lagos, where they reside.
According to the Police, the man lured the victim into his apartment, used words of mouth to hold her, then romanced and fondled her breasts. She became confused and was unable to resist it before he penetrated her.
By the time he had satisfied himself, the victim regained her senses and raised alarm that the suspect engaged her in sex romp without her consent. She reported the matter to the Police at Igando Division.
Thus, the Police moved into action, arrested the man and detained him at the station for interrogation over his alleged conduct.
While being interrogated, the man admitted to have penetrated her but with her consent because she did not resist it.
However, the victim insisted that he romanced and fondled her breasts and penetrated her in the process because she was confused and was unable to resist him.
The Police found him culpable and charged him before the Ogba Magistrate Court for the alleged offence, which attracts several years of imprisonment.
Part of the charges read:
COUNT1: “That you, Olukayode  Oguntolu, at Oloruntobi Street, Fatoki Egan Igando, Lagos, in the Lagos Magisterial District, unlawfully had sexual intercourse with the victim aged 20 years and thereby committed an offence punishable under Section 260 of the Criminal Law of Lagos State of Nigeria 2015.”
COUNT II:”That you, Olukayode Oguntolu on the same date, time and place, in the aforesaid Magisterial District, did sexually asault the victim by romancing and touching her breasts and thereby committed an offence punishable Section 263 of the Criminal Law of Lagos State of Nigeria 2015.”
However, the Court did not take his plea following a motion moved by the prosecutor,  Inspector Lucky Ihiehie, asking the Court to give a date and refer the matter to the DPP for legal advice.
The Presiding Magistrate, Mrs. M.O.Tanimola, ordered his remand in custody at the correctional center at Kirikiri town, Lagos, pending the outcome of the DPP’s advice and directed the prosecutor to duplicate the file and send it to the DPP for advice.
The matter was adjourned for mention for the report of the DPP’s advice to be available, which will determine if the matter will be transferred to the High Court or not over jurisdiction.
