Ogun West: Senator Adeola Yayi Wins Again At Appeal Court

Posted on February 16, 2023
The candidate of the All Progressives Congress, Ogun West Senatorial District, Senator Solomon Adeola Yayi, has again floored his opponents at the Appeal Court.

The constitution of the Federal Republic of Nigeria has once again stood in the defence of Senator Solomon Olamilekan Adeola Yayi, the APC senatorial candidate for Ogun West in the 2023 general elections.

Delivering his judgement at the Court of Appeal sitting in Ibadan in the appeal filed by Johnson Akindele Akinsanya and two others against Senator Solomon Olamilekan Adeola Yayi, Justice Nimpar JCA held that the matter is a pre-election matter and a statute barred having being filed outside the 14 days prescribed by section 6(6) of the constitution of the Federal Republic of Nigeria.

The Appeal Court did not tamper with the award of cost by the lower court which it described as being in line with the rules guiding award of cost. Justice Nimpar awarded the cost of N1 million against the appellants in favour of the 1st and 3rd respondents.

The appeal was dismissed.

The lower Federal High Court in Abeokuta had dismissed the case against Senator Adeola and awarded a cost of N4million against the plaintiff.
